Dear Jason,

Thank you for writing eBay in regard to Image and Text Theft.

I reviewed your information about the possibility of image and text
theft. At this time, I didn't find sufficient evidence to show that the
member has violated any eBay policies.

Please understand that in some situations members will allow others to
use their images. It's also possible that the members acquired the photo
from the same source or a source that we can't verify. If this is the
case, eBay can't remove the listings.

We will be able to take action only if the person who owns the image or
text writes to us directly. If you feel strongly about this issue, I
recommend that you contact the seller, informing him or her about your
concerns and recommending that he or she contact eBay. Once we hear from
the seller, we will then take the appropriate action.

It is my pleasure to assist you. Thank you for choosing eBay.

Sincerely,
Nicole

Message: cowboysnumber1 is using 'stolen' images in his listing, i
called him out on it after realizing my mistake for purchasing without
investigating...in item 120281007346 there are at least 5 stolen images,
those images come from items 230267080109, 290243931648, 170235596374,
150266915683, and 170235524335. Seller has been smug about not stealing
the images saying i have no idea what i am talking about, that i cant be
unhappy by just getting assorted junk instead of one of the cards
listing, it is OBVIOUS that he does not have the cards portrayed in his
images, and im sure if i spent more time i could find the original
images of all images used in the listing...how do i know?...all images
have the EBAY logo in the corner of them, and for this type of listing,
hosted images would not have a logo...
seller also purchased an item from my store, which is definately an
attempt to file a claim or leave a negative on me...i have already
refunded the money to him, as i want nothing to do with him or his
transaction, and i believe he is a liability to ebay and paypal,
definately not an assett.
i can only hope that you take the time to fully review the sellers
actions, as well as the messages sent to me from him, and suspend the
member...if needed i can contact the originators of the images to file
complaints as well, but i dont feel that should be necessary, when it is
quite clear the seller is a fraud.

so i called in and talked to a live operator...

the images are hosted by a 3rd party, so they cant 'trace' the uploading of images, so i asked

"if they are hosted by a 3rd party, they shouldnt contain the ebay watermark correct"

"that is correct"

"then shouldnt that be a clue when almost all of the images in that listing contain the ebay watermark but when uploaded from a 3rd party site the watermark isnt imposed on the picture"

"i see what you are saying, but i cant do anything about that, we are general service and that is something that is taken care of by the security department"

"shouldnt that be the first clue that the images are stolen from other listings"

"i can put it in my notes"

:rambo:

are you kidding me?...the security department says that the images arent stolen, but they contain ebay watermark logos which arent put in place by ebay when hosted off site?

Ebay will pull only the items they fell like pulling and support the power sellers. everyone else who cares

yeah more concerned with the Power Seller than the Honest Seller...

good news is today, i looked closely, found a personal watermark on one of the cards, traced it to the seller, contacted seller, and passed the info on to ebay....this is retarded, seriously

well lets see what happens :pop:

let the games begin...

spoke with ebay tuesday night and they said that "grab bags" are illegal, so i was on with live help earlier and got this

6:04:01 PM sliqwill so it is a "lottery" correct? as per definition?
6:04:02 PM Jesselle R. I can only give my opinion about this item.
6:05:36 PM Jesselle R. As per definition yes it is.

so they admit its a lottery, they dont have a gambling license, reporting to the state gaming boards of CA and PA, home of ebay, and home state of the seller

GAME ON
