New Jersey's Supreme Court will determine what role a racial slur will play in the reckless manslaughter retrial of former NBA star Jayson Williams.

The court said Tuesday it would hear oral arguments from prosecutors and defense attorneys. No date was set.

The slur was uttered by an investigator who didn't testify in Williams' first trial in 2004 and later retired.

Williams' attorneys want access to documents about the slur and a subsequent investigation. Prosecutors have argued the incident should not be part of the retrial.

Williams was acquitted of aggravated manslaughter in 2004 but convicted on four counts of trying to cover up the 2002 shooting of a hired driver. The jury deadlocked on a reckless manslaughter count.
